Introduction
Welcome to SREF Mining Co. ("SMC," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the SMC web application, website, and related services (collectively, the "Service"), which are owned and operated by Abbreviated Media. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1. Description of the Service

SMC provides a platform for users to discover, save, organize, and utilize style reference (SREF) codes for use with AI image generation tools like MidJourney. The Service includes functionalities for managing these codes, associated example images, and user-created collections.

Service Limitations:

  • Currently, the Service only supports the saving of SREF codes, either individually or in combinations formatted for MidJourney's suffix parameter.
  • Codes can only be saved with a single style version number (e.g., --sv 4 or --sv 6), not multiple.
  • Future updates may introduce support for more advanced code types (e.g., mood boards, profile codes), but these are not currently supported and are not guaranteed.
2. User Accounts and Tiers

To access most features of the Service, you must register for an account. We offer two main tiers of service:

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3. User Content and Intellectual Property Rights

Clarification of Intellectual Property Rights:

SREF codes are technical property originating from third-party platforms (e.g., MidJourney). Neither SREF Mining Co. nor its users claim any ownership rights over the SREF codes themselves.

You retain full ownership of the intellectual property rights in the original content you create and associate with a SREF code. This "Reference Information" includes the unique act of discovering and saving a code, any descriptive text, tags, personal notes, and the specific example images you generate and upload. This collectively constitutes your "User Content."

License Grant to Abbreviated Media:

Public Content (All Tiers):

For any User Content you save as "public," you grant Abbreviated Media a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in connection with operating and promoting the Service.

Free Tier ("Miner") Accounts:

All User Content saved by a Free Tier account is considered Public Content. Free Tier accounts have no ability to save content privately. Your content will be available for use, viewing, and saving by any user on the platform.

Private Content (Paid Tier "Claimant" Only):

For any User Content you save as "private," you grant Abbreviated Media a limited, worldwide, non-exclusive, royalty-free license solely to host, store, display, and reproduce the content as necessary to provide the Service to you. We will not make your Private Content publicly available or share it with third parties, except as required by law.

4. User Conduct

You are solely responsible for your conduct and your User Content on the Service. By using SMC, you agree to:

  • Be polite and maintain a civil tone in all public-facing content, including the naming and tagging of SREF codes.
  • Ensure all uploaded or created content, especially example images, is appropriate for a general audience (i.e., "PG-rated").
  • Comply with all applicable laws and regulations.
  • Not engage in any activity that is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable.
  • Not infringe on the intellectual property rights of others.
  • Not attempt to reverse engineer, decompile, or otherwise access the source code of the Service.
5. Fees, Payment, and Subscription Terms

Paid Tier ("Claimant") Subscriptions:

Certain features of the Service are only available to users with an active Paid Tier subscription. Fees are billed on a recurring basis (e.g., monthly).

Grandfathered Pricing:

For Paid Tier accounts, we operate on a "grandfathered pricing" model. The monthly fee you agree to upon initially signing up for a Paid Tier subscription will remain your fixed monthly fee for the continuous lifecycle of your membership. This price is protected against future price increases or feature upgrades for the same tier, provided your subscription remains continuously active.

Subscription Cancellation vs. Account Deletion:

It is critical to understand the difference between cancelling your subscription and deleting your account.

⚠️ Strategic Consideration: If you have private content that must remain private for business or other reasons, it is strongly recommended that you maintain your Paid Tier subscription or, at minimum, cancel your subscription (downgrading to the Free Tier) rather than deleting your account entirely.

6. Termination

Termination by Abbreviated Media:

Abbreviated Media maintains a zero-tolerance policy for violations of these Terms. We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, for any reason, including but not limited to a breach of these Terms. We will provide notice of termination via email, which may include an explanation for the termination.

Effect of Termination by Abbreviated Media:

If your account is terminated by us, even if you are on a Paid Tier, all of your User Content (both public and private) will be handled at the sole discretion of Abbreviated Media. This may include:

  • Permanent deletion of some or all of your User Content.
  • Permanent migration of some or all of your User Content to a corporate-level account, making it publicly available for continued use by the SMC community.

You will not be entitled to a refund for any prepaid fees upon termination.

7. Intellectual Property of the Service
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Abbreviated Media and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of Abbreviated Media.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, ABBREVIATED MEDIA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ABBREVIATED MEDIA MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS.
9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ABBREVIATED MEDIA, ITS AFFILIATES, AGENTS, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

UNDER NO CIRCUMSTANCES WILL ABBREVIATED MEDIA BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS PAID BY YOU TO ABBREVIATED MEDIA FOR THE PAST TWELVE (12) MONTHS FOR THE SERVICE.

10. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Delaware for the resolution of any disputes arising out of these Terms or the Service.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
